Kratom’s active alkaloids, mitragynine and 7-hydroxymitragynine, are chemically distinct from those categories, making them invisible to traditional immunoassay tests.

However, specialized toxicology labs can identify Kratom through advanced methods such as liquid chromatography-tandem mass spectrometry (LC-MS/MS). Because these tests are more expensive and not required by federal guidelines, employers rarely use them, unless Kratom use is suspected or the role involves safety-sensitive duties like transportation, healthcare, or operating heavy machinery.

Kratom: Unscheduled, Unprotected, and Fragmented

Kratom, scientifically known as Mitragyna speciosa, occupies a distinct and much more precarious legal position. It is not currently scheduled under the federal Controlled Substances Act, a status that technically makes it legal in the majority of the US. Yet, this de facto legality is a double-edged sword. 

Unlike cannabis, Kratom doesn’t benefit from organized, industry-driven legislative efforts to protect employee use. Instead, its legal status is a confusing, dangerous patchwork, with several states and numerous counties enacting outright bans, classifying it as a Schedule I substance, while other states adopt the Kratom Consumer Protection Act to regulate its sale.

For an employer, this absence of a clear federal mandate and a fragmented state regulatory environment provides far greater discretionary power. There are virtually no state statutes protecting an employee’s use of Kratom outside of work. 

Consequently, an employer can easily institute a policy that prohibits Kratom use entirely, often citing the FDA’s severe health warnings, and face minimal legal challenge if they terminate an employee who tests positive, regardless of Kratom's legality in that specific state.

Why Employers Enforce Zero-Tolerance Policies for Kratom

Employers’ caution toward Kratom isn’t based solely on legality; it’s rooted in pharmacology and safety risk. Kratom acts on opioid receptors, producing dose-dependent effects that range from mild stimulation at low doses to sedation and opioid-like pain relief at higher doses.

While Kratom has a long history of traditional use in Southeast Asia, where laborers consumed it to relieve fatigue and pain, its modern Western use is largely unregulated. The FDA has issued multiple warnings about Kratom’s potential for addiction, liver toxicity, seizures, and respiratory depression.

A more significant concern arises from adulteration. Independent testing has uncovered Kratom products contaminated with controlled substances, including synthetic opioids like fentanyl, as well as heavy metals and other harmful additives.
